Misonics Pty Ltd (ABN 50 659 454 681) (Misonics, we, us, our) offers trade accounts to approved business customers. Because we may give credit for 7 days or more, the credit reporting provisions in Part IIIA of the Privacy Act 1988 (Cth) and the Privacy (Credit Reporting) Code apply to any credit information we hold about an individual — a sole trader or partner who applies for an account. This policy explains how we handle that information. It sits alongside our Privacy Policy, which covers all other personal information.
Our normal practice is to assess a company customer on the company itself — company searches, a commercial credit report on the company and trade references — without obtaining a credit report about any individual, and we do not ask directors for personal guarantees. We obtain a credit report about an individual only where the applicant is a sole trader or a partnership, the application form says so and the individual has agreed. Every account carries a credit limit, and machines and equipment are never supplied on account.
What credit information we may collect and hold
Identification details: name, date of birth, address, driver licence number where needed to identify you to a credit reporting body. Information from your application: the credit you have applied for, trade references and your role in the business. Credit reporting information from a credit reporting body: your credit report, including credit enquiries, defaults, court judgments, personal insolvency and the body's credit score. Our own records about the account: the credit limit, whether payments are made on time, overdue amounts, and any default we have listed.
We do not collect repayment history information, which the law reserves for licensed consumer credit providers.
How we collect it and from whom
From you, in the credit application. From the credit reporting bodies we use — Equifax Australia (equifax.com.au), illion (illion.com.au) and Experian Australia (experian.com.au) — each of which publishes its own credit reporting policy on its website. From your trade referees, with your consent. From publicly available records such as ASIC and court registers.
What we use it for and who we disclose it to
To assess an application for a trade account; to set and review the credit limit; to manage the account and collect overdue amounts; and to meet our legal obligations. We disclose credit information only to the credit reporting bodies named above, to our debt collection agents and legal advisers when an account is in default, to our professional advisers, and where the law requires or permits. We do not disclose credit information to anyone overseas.
If an amount of $150 or more is 60 days or more overdue and we have given the notices the law requires, we may list a default with a credit reporting body. A credit reporting body may include information we give it in reports to other credit providers to assess your creditworthiness.
Your rights
You may ask a credit reporting body not to use your credit reporting information for direct-marketing pre-screening, and, if you believe you have been or may be a victim of fraud, to place a ban period on your file. You may ask us for access to the credit information we hold about you and to correct it; we respond within 30 days and do not charge. If we decline, we tell you why and how to complain.
Complaints go to the Privacy Contact at [email protected] or 1300 647 664 (1300 MISONICS), or by post to 4527 G, 470 St Kilda Road, Melbourne VIC 3004. We acknowledge a complaint within 7 days and aim to resolve it within 30 days, consulting the credit reporting body where the complaint concerns information it holds. If you are not satisfied, you may complain to the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.
Notice given at collection
This notice appears on the credit application, above the signature, with a box the applicant ticks to agree. It only applies where the applicant is an individual — a sole trader or partner; a company application is assessed on the company.
Retention and security
Credit information is held in our secured business systems with access limited to the people who assess and manage accounts. Credit reports are destroyed or de-identified when no longer needed for the account, and in any case within 7 years of the account closing, unless the law requires longer. Copies of this policy are available free on request.
